Terms & Conditions
Below are the terms and conditions for working with AD Fitness & Nutrition. Upon signing with the business or purchasing on AD Fitness & Nutrition’s online store, you agree to the following and also confirm that you are of legal age in your country to participate in our programs and/or services.
Minimum Commitment
There is a minimum 12 week commitment period when joining our online coaching service and you are expected and required to commit to this term. If you decide to cancel at any time during this period, you will be required to pay the 12 weeks in full. If you want your service to be put on hold during this 12 week term, your direct payments will still occur as normal for the remaining weeks left until you conclude your 12 weeks and however many weeks you paused the program, will be credited back to you once you return. When put on hold, you will lose access to the client exclusive application. However many weeks you may have in credit are only valid for 6 months from the date you pause your program. At the end of the first 12 weeks, you will have a choice to either finish the online coaching program or continue on for either another 12 week or 6 week block. If you choose to continue for another block, this is to be communicated to us in writing and the same minimum commitment term will apply for the duration you choose to continue. This will be applied each time you finish a block. For our one off training program, this is a 6 week commitment period and we do not offer any pauses or cancellations during this term. This program is to be paid upfront, upon signing up. Towards the end of the 6 week term, you will be asked if you would like to continue for another 6 weeks. If you outline yes to this, you will be be required to pay in full again for the next 6 weeks.
Payment of Service
You will be required to pay any one off on-boarding fee upfront and for any online coaching program, this is to be paid via direct debit and will have the choice of paying either weekly, fortnightly or upfront in full. Billing will commence on your start date. If a payment fails, our system will automatically try to recharge your card with a possible 3% overdue fee added. In the event of ongoing payment failures, you will be at risk of your service being put on a temporary or permanent hold with the requirement of the remaining weeks you have left on your current commitment term to be paid in full. Refunds are not applicable with any of our services and/or programs. Once a new week begins and your personalised plan has been delivered, payment for that week is required and non-refundable, regardless of participation or completion. By receiving the plan, you agree to pay for that week’s coaching service. If you have any changes to your bank card or payment method, you are required to inform us immediately. You agree to supply accurate and current account information for all transactions and programs you engage in. You are responsible for updating your account details, such as your credit card number and expiration date, in a timely manner to facilitate the completion of your transactions and direct debit payments. In the event that you decide to terminate your participation before you commence the program, any payments already made will not be refunded.
Online Coaching
You are expected to complete your check-in by the specified time and day. Any late submissions may be pushed back and reviewed in the following week, meaning you will miss a week of check-ins. You are expected to maintain respectful communication. Any offensive language, defamatory remarks, or inappropriate behaviour will not be tolerated and may result in immediate cancellation of your service. All meal plans, training programs and any other personalised or non-personalised content provided as part of AD Fitness & Nutrition’s services are delivered exclusively through our client application. These programs and materials are not provided in downloadable, transferable or external formats. Access to the client application is granted for the duration of your active coaching term only. Upon completion, cancellation or termination of your program for any reason, access to the client application and all associated content will be revoked. You acknowledge and agree that meal plans and training programs are not accessible once your coaching term has ended and that continued access requires an active, paid coaching service.
Online Store
You agree not to reproduce, distribute, replicate, sell, resell, or otherwise exploit any part of our service and/or programs, its use and access to the service without our prior written consent.
Medical Disclaimer
Upon signing up with us, you will be required to fill out a pre-screen form and if you disclose any pre-existing conditions and/or disability, you will be required to provide a doctor's referral. You understand you are solely responsible for your own safety and wellbeing when training and agree to not hold AD Fitness & Nutrition available for any injuries or medical conditions that may occur during your time with our service and/or programs. You understand that AD Fitness & Nutrition is not a licensed healthcare provider and does not offer medical advice. The coaching and programs provided are for general fitness purposes only and should not be construed as medical advice or a substitute for medical treatment.You acknowledge that any nutritional advice provided is general in nature and we do not provide diagnosis or treatment outside of our scopes of practice. You agree to seek medical approval from a licensed healthcare provider before beginning any fitness program if you have pre-existing medical conditions, physical limitations, or concerns. This includes, but is not limited to, heart conditions, joint issues, or any other medical conditions that may affect your ability to engage in physical activity safely.
Liability
AD Fitness & Nutrition does not accept liability, injuries or illness sustained during or after our service and/or programs. By using our service and/or programs, you are aware that results are not guaranteed and it is your responsibility to ensure you are following the personalised program to assist in achieving results.
Personal Information
You understand that your personal details will be stored for our purpose of delivering you a service. All personal information will be kept confidential and will not be shared with a third party without your consent. Upon booking in a free consultation call with Audrey, providing your email via social media & signing up with AD Fitness & Nutrition, you hereby consent to being added to the emailing list of AD Fitness & Nutrition. You acknowledge that you may receive promotional and information emails from us.
Coach Availability & Annual Leave
AD Fitness & Nutrition reserves the right to take annual leave throughout the year. Clients will be provided with reasonable notice of any scheduled annual leave periods via written communication.
During periods of annual leave, weekly check-ins will be paused. However, the coaching service will otherwise continue as normal. This includes, but is not limited to:
- Access to your meal plans and/or training program
-Ongoing access to the client exclusive application
-Message support
- Program progression/adjustments as required
Annual leave periods do not pause, extend, or alter the minimum commitment term or payment schedule.
By agreeing to these terms, you acknowledge and accept that temporary pauses to weekly check-ins may occur due to coach annual leave and that this does not constitute a breach of service.
